Justice Omotosho orders Nnamdi Kanu not be detained at Kuje Correctional Centre due to security risks, ensuring a safer, federally monitored facility.

In a significant ruling, Justice Omotosho of the Federal High Court in Abuja has directed that Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), must not be remanded at the Kuje Correctional Centre. The decision highlights security concerns, custodial risks, and the sensitive nature of Kanu’s ongoing legal and political matters.

The ruling follows a series of convictions and sentences against Kanu, prompting the court to review appropriate custodial arrangements. Justice Omotosho emphasized that Kuje Correctional Centre, previously the site of a major jailbreak by armed insurgents, lacks sufficient security for a high-profile inmate like Kanu. The judge cited intelligence reports and national security assessments indicating that detaining Kanu at Kuje would pose undue risks both to him and the facility’s stability.

The court clarified that this decision is not a preferential treatment but a precautionary measure aimed at safeguarding the judicial process and Kanu’s personal safety. Referencing the 2022 Kuje prison attack, where over 600 inmates escaped, Justice Omotosho stressed the need for a more secure, federally monitored facility. The specific location of Kanu’s new detention was withheld to ensure security.

Kanu’s legal team reacted with cautious approval. Lead counsel Alloy Ejimakor acknowledged that Kuje had long been criticized as unsafe and inadequate. However, he raised concerns about transparency, emphasizing the need to protect Kanu’s rights to legal representation, medical care, and family contact. The defence plans to file motions seeking clarity on Kanu’s welfare in the new custodial arrangement.
