The leader of the Indigenous People of Biafra (IPOB), Mazi Nnamdi Kanu, has declined to open his defence in the ongoing terrorism trial against him, insisting that there is no valid case before the Federal High Court in Abuja.
At the resumed hearing on Monday, October 27, 2025, before Justice James Omotosho, Kanu announced that after reviewing his case file, he found no legitimate charges warranting a defence. This comes after the court had adjourned the matter on October 24, granting him time to prepare and summon witnesses for his defence.
However, during today’s sitting, Kanu told the court he would no longer proceed with his earlier plan to call witnesses. According to him, the charges were baseless and his trial amounted to an unlawful prosecution.
Justice Omotosho, in response, advised the IPOB leader to seek advice from criminal law experts to fully understand the implications of his decision. The judge further instructed Kanu to file a written address detailing his position and to serve it to the prosecution for review.
The court subsequently adjourned the case until November 4th, 5th, and 6th, 2025, for the adoption of final written addresses. The adjournment will allow the court to determine whether the evidence presented by the prosecution so far has established a prima facie case against Kanu or whether he should proceed to open his defence.
Kanu’s latest position adds a new twist to the long-running trial between him and the Nigerian government, a case that has drawn both national and international attention since his re-arrest and extradition in 2021.
