Attorney General of the Federation and Minister of Justice, Lateef Fagbemi (SAN), has clarified that none of the inmates approved for clemency under President Bola Ahmed Tinubu’s recent exercise of the prerogative of mercy have been released from detention.
In a statement issued by his office, Fagbemi explained that the presidential pardon process is still undergoing a final legal and administrative review to ensure full compliance with established procedures.
“The Office of the Attorney-General of the Federation and Minister of Justice wishes to clarify that no inmate approved for clemency under the recent exercise of the President’s power of prerogative of mercy has been released from custody,” the statement read.

He noted that the final stage of the exercise following the Council of State’s approval is the issuance of an official instrument for implementation. This stage allows for a final check of all names and recommendations before forwarding the list to the Controller-General of Corrections for necessary action.
According to Fagbemi, the verification process is a standard protocol aimed at ensuring transparency, due diligence, and adherence to the rule of law. He stressed that there is no delay, adding that the government is taking every legal step to ensure only duly qualified individuals benefit from the President’s mercy.
“This verification process reflects the government’s commitment to transparency and due diligence. The rule of law does not rush it ensures fairness,” he emphasized.
The Attorney General further appreciated the public’s vigilance and constructive engagement, describing it as a sign of Nigerians’ deep concern for justice and good governance.
Fagbemi assured that the public would be duly informed once all legal and procedural checks are concluded.
